Senate Judiciary Committee Chairman Lindsey Graham made a comment about the “good old days of segregation”. The remark occurred during the third day of Amy Coney Barrett‘s confirmation hearing.

Barrett is President Donald Trump’s nominee to replace Ruth Bader Ginsberg in the Supreme Court. Barrett met with the Senate for a confirmation hearing for the position. Some have criticized Barrett for refusing to share her opinions on subjects like Roe v. Wade and Obamacare, according to CNN.

During the third day of the hearing, Graham defended Barrett’s right to withhold her opinion. He said there was upcoming litigation within the Supreme Court on those issues. However, he did want to know her opinion on Brown v. Board of Education and segregation. He referred to segregation as the “good old days.”

“One of the reasons you can’t tell us how you would rule is because there’s active litigation coming to the court,” Graham said. “And one of the reasons you can say with confidence that you think Brown v. Board of Education is super-precedent is you’re not aware of any effort to go back to the good old days of segregation.”

Graham is a Republican senator from South Carolina. He’s been in his position for the state since 2003 and is currently up for reelection. During the hearing, he also discussed how much his rival Democratic candidate Jaime Harrison had raised in his senate campaign, according to Yahoo News.

“I can tell you there is a lot of money being raised in this campaign. I’d like to know where the hell some of it’s coming from. BUT, that’s not your problem,” Graham said during the hearing.
